Conditions of payment, determined by the Nederlandse Organisatie
van Verloskundigen (Netherlands Organization of Midwives), established
by statute in Utrecht, registered at the district court in Utrecht
on Jun 21, 1996 , under number 165/1996.
For complete or partial assistance
at a delivery, given by a midwife or his/her substitute, the following
conditions apply:
- Term of payment
Payment for assistance at a delivery must be made within 30 days after the date of the invoice by the client to the midwife who assisted her during her pregnancy, without any deduction, adjustment or discount.
- Interest
When the term of payment has passed the client will be considered to be in default without serving notice. From the due date of the invoice, the client will owe a monthly interest of 1% over the amount due, where part of the month is considered as one full month.
- Collection charges
If the client, after being given notice, still fails to pay, all legal and non-legal collection charges that the midwife has to make in order to get full payment will be, without further notice, payable by the client. Collection charges will amount to at least 15% of the claim, added to which are the costs for the VAT owed in as far as the midwife cannot reclaim it. Collection charges include among others the cost of legal assistance, the employing of a debt-collecting agency, bailiff or lawyer.
- Proof
In order to determine the amount owed by the client, the administrative data of the midwife are decisive, unless the client can explicitly prove otherwise.
- 5) Dispute arbitration
All disputes resulting from an agreement based on these conditions will be brought before the judge who has jurisdiction in the place of residence of the debtor. If the difference between parties is outside the jurisdiction (competence) of the regional judge, the midwife may re-open the case with the court in Utrecht.
